Government Pension Offset

The Government Pension Offset (GPO) was a Social Security Administration provision that reduced Social Security spousal or survivor benefits received by individuals who also collected a government pension from employment not covered by Social Security, before its repeal by the Social Security Fairness Act signed in January 2025.

Many state and local government employees — teachers, firefighters, police officers, and other public workers — participate in pension systems that do not participate in Social Security. When these workers retired and became eligible for Social Security spousal or survivor benefits based on a spouse's record, the GPO reduced those benefits by two-thirds of the government pension amount received.

The GPO was distinct from the Windfall Elimination Provision (WEP): the GPO applied to spousal and survivor benefits, while the WEP affected benefits earned on the worker's own Social Security record. Both provisions were designed to prevent windfall benefits for workers who split their careers between Social Security-covered and non-covered employment.

In practice, the GPO could completely eliminate a spousal benefit. A retired teacher receiving a $3,000-per-month state pension who would otherwise have been entitled to $1,800 per month in Social Security spousal benefits would have had that spousal benefit reduced by $2,000 (two-thirds of $3,000), leaving nothing to receive. This outcome was criticized as disproportionate and generated repeated legislative reform proposals.

The Social Security Fairness Act, signed into law in January 2025, repealed both the GPO and the WEP. Workers and their survivors who were previously affected became entitled to higher Social Security benefits, and the Social Security Administration began recalculating and retroactively paying affected individuals. This repeal represents one of the most significant Social Security benefit expansions in decades, with particular impact on public school teachers and state and municipal government employees.
